Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the bananotate application (the "Service") operated by bananotate ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Licenses

1.1 License Types

The Service offers two license types: Free and Pro. Each Pro license provides permanent lifetime access to all features and updates, with a 30-day money-back guarantee.

1.2 Feature Access

Pro licenses include lifetime access to all current and future features with no additional payments required. The Free tier provides access to core features, essential annotation tools, and basic editing features.

1.3 Device Limitations

Pro licenses allow activation on a specified number of macOS devices (1-5) simultaneously, as determined by your purchase. The number of simultaneous device activations cannot exceed your purchased limit.

1.4 License Management

Users can manage their device activations through a personal web dashboard. Devices can be activated and deactivated at any time, provided the total number of active devices stays within the purchased limit.

1.5 Refund Policy

We offer a 30-day money-back guarantee on all Pro licenses. If you are not satisfied with the Service for any reason, you may request a full refund within 30 days of your purchase. Refund requests after the 30-day period will be evaluated on a case-by-case basis.

2. Updates and Modifications

2.1 Software Updates

The Service may automatically check for, download, and install updates. By using the Service, you agree to such automatic updates. All updates are included free of charge with your license.

2.2 Modifications to the Service

We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.

3. Intellectual Property

3.1 Ownership

The Service and its original content, features, and functionality are and will remain the exclusive property of bananotate and its licensors.

3.2 User-Generated Content

You retain any copyright you may have in the content you create using the Service. By using the Service, you grant us a license to use, store, and copy that content in connection with the Service and your account.

4. Acceptable Use

You agree not to use the Service:

• In any way that violates any applicable law or regulation
• To transmit any material that is defamatory, offensive, or otherwise objectionable
• To attempt to interfere with or disrupt the Service or servers or networks connected to the Service

5. Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

6. Disclaimer of Warranties

The Service is provided "as is" and "as available" without any warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

7. Limitation of Liability

In no event shall bananotate, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

8. Third-Party Libraries

The Service uses third-party libraries and components. Use of these libraries is subject to their respective licenses.

9. Privacy and Data Collection

Your use of the Service is also governed by our Privacy Policy, which covers how we collect, use, share, and store your personal information. By using the Service, you consent to the collection and use of information as outlined in the Privacy Policy.

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of Israel, without regard to its conflict of law provisions.
